1. The Contract

1.1 These terms apply to all goods and services supplied by us.

1.2 A legally binding contract is formed when we send you an Order Confirmation email. We reserve the right to decline any order.

2. Goods & Services (Consumer Rights)

2.1 Standards: Under the Consumer Rights Act 2015, we must provide goods that are of satisfactory quality, fit for purpose, and as described. Services must be provided with reasonable care and skill. 

2.2 Descriptions: Images on our website are for illustrative purposes. We make every effort to display colours and dimensions accurately, but your product may vary slightly.

3. Pricing and Payment

3.1 All prices include UK VAT (where applicable) at the current rate. 

3.2 Delivery charges will be clearly displayed before you confirm your order. 

3.3 We use Squarespace to handle transactions. Payment is due at the time of order.

4. Right to Cancel (The "Cooling-Off" Period)

4.1 The 14-Day Right: As a UK consumer, you have the right to cancel this contract within 14 days without giving any reason. 

4.2 When the period starts:

  • For Goods: 14 days from the day you (or a third party nominated by you) receive the items.

  • For Services: 14 days from the day the contract was formed. 

4.3 Exemptions: This right does not apply to:

  • Personalised/Bespoke items made to your specifications.

5. Refunds and Returns

5.1 Faulty Goods: Within 30 days of delivery, if the goods are faulty, you are entitled to a full refund. After 30 days, we reserve the right to repair or replace the item first. 

5.2 Change of Mind: If you cancel under the 14-day cooling-off period, we will refund all payments received from you, including standard delivery costs. You must pay the direct cost of returning the goods. 

5.3 Deductions: We may reduce your refund if the value of the goods has been diminished by unnecessary handling (i.e., more than you would do in a physical shop) or damage.

5.4 Responsibility for Returns: When returning an item, you are responsible for ensuring it is packaged securely to prevent damage during transit. We recommend using the original packaging where possible. The goods remain your responsibility until they are physically received at our premises. We strongly advise using a tracked and insured delivery service, as we cannot issue a refund for items that are lost or damaged in transit back to us.

6. Limitation of Liability

6.1 We do not exclude or limit our liability for death or personal injury caused by our negligence, or for fraud. 

6.2 We are responsible for foreseeable loss or damage caused by us breaking this contract, but we are not responsible for any business losses (e.g., loss of profit).

7. Governing Law

7.1 These terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.

8. Usage Restrictions

8.1 All goods sold via this website are intended for decorative purposes only unless the individual product description specifically states otherwise. They are not tested or certified for functional, industrial, culinary use or heavy-duty use. No products on this site are dishwasher safe, unless the individual product specifically states otherwise. We accept no liability for any loss or damage resulting from the use of decorative items for functional purposes.

9. Delivery & Transit Damage

9.1 Transit Damage: We take great care in packaging our decorative items, but accidents can happen during transit. Please inspect your goods as soon as possible upon receipt. If you notice any damage, we request that you report it to us at hello@swn-y-mor-ceramics.co.uk within 48 hours of delivery, providing photographic evidence of both the damaged item and the packaging. This helps us file a claim with our courier. Your statutory rights under the Consumer Rights Act 2015 remain unaffected if damage is discovered later.
